Terms and conditions
Last updated
These terms apply to two parts of Pocket Journal, together "the service":
- The website is pocketjournal.in: the pages about Pocket Journal, its pricing and its blog.
- The apps are the billing apps for each kind of business (Food, Retail, Travel and any we add later). Each runs at its own address under pocketjournal.in, such as food.pocketjournal.in, retail.pocketjournal.in and travel.pocketjournal.in. This covers every way you use them: in a browser, installed on a phone or computer, or any other form.
The service is operated by Aritra Paul, a sole proprietorship, trading as Pocket Journal, at Bhaktinagar, Shaid Colony, Siliguri, Jalpaiguri, West Bengal 734007. In these terms "we" and "us" mean that operator. "You" means the business that signs up and every person it gives a login to.
By creating an account or using the service, you agree to these terms and to our privacy policy. If you accept them for a business, you confirm that you are allowed to bind that business.
The service
Pocket Journal is billing software. It creates GST invoices and keeps your ledger and reports. Each kind of business has its own app. Features may change as the product develops. If we remove something your business depends on, we will give you notice.
Your account
- The details you give us must be true, and you must keep them up to date.
- You decide who in your business gets a login and what each person can do. You are responsible for everything done under your business's logins.
- Keep passwords private. If you think a login has been misused, tell us straight away.
- You must be at least 18 and running a lawful business in India.
Your data
Your invoices, customers, items and ledger belong to you. You allow us to store, process and back them up only as needed to provide the service. We do not sell your data or use it for anything else. The privacy policy has the details.
Your plan decides how many past years you can see in the app. We keep your invoices, ledger and supplier bills for 8 years from the end of the financial year they belong to, and send any year you ask for, while your account is open or after it closes. The privacy policy explains what else is kept and for how long.
Your responsibilities
The software calculates tax from the rates, items and details you enter. You are responsible for the accuracy of your invoices and returns, and for meeting your obligations under GST and other laws. Check what you issue. We are not your tax adviser or accountant.
You agree not to:
- use the service for anything unlawful, or to issue false or misleading invoices
- try to reach another business's data, or test, probe or bypass the service's security
- overload the service, or copy or resell it
- upload malicious code
Fees and payment
- Your plan and its prices are shown on our pricing page, or agreed with us when you sign up.
- Setup. A new account starts with a one-time setup payment. It covers setting up your company and your first 3 months on our highest plan with every limit lifted. After those 3 months you choose a plan.
- Plan limits. Each plan includes a number of bills a month. Extra bills are charged per bill, up to the most bills the plan allows. If you pass that, the next plan up applies for that month and billing does not stop. Other limits, such as products, saved customers and storage, stop you adding more until you move up a plan or remove some. Reaching a limit never deletes or hides what you already have.
- Changing plans. You can move up or down. The new plan starts from your next billing cycle.
- We bill at the end of each billing cycle for that cycle's plan and any usage above its limits, such as extra bills. You pay only for a cycle you have used.
- Invoices are due within 15 days. Prices do not include taxes, which are added where they apply.
- If an invoice looks wrong, tell us within 15 days of receiving it and we will look into it. You still pay the part of the invoice that is not in dispute.
- If an invoice stays unpaid after the due date and a reminder, we may make your account read-only until it is paid. You can still view and export your data.
- We will tell you at least 30 days before a price change. The change applies from the first billing cycle that starts after the notice period ends.
Refunds
If the service is not right for your business, tell us within 15 days of your account going live and we will refund the setup payment in full. The refund is paid to the method you paid with, within 7 working days of your request.
Plan fees are billed at the end of each cycle for a cycle you have already used, so they are not refunded. Apart from the setup refund above, payments are not refundable unless the law requires it or we have charged you in error.
Availability
We work to keep the service running and your data backed up, but we do not promise it will never be interrupted. We may take it down briefly for maintenance and will try to do that outside business hours. Keep your own exports of records you cannot afford to lose.
Ending the arrangement
You can close your account at any time. You will receive a final invoice for the cycle up to the day you close, and you then have 30 days to export your data in the app. After that, your business records stay available on request for the rest of their 8 years.
We may suspend or close an account that breaks these terms or leaves invoices unpaid. Except in cases of serious misuse, we will warn you first and give you time to put it right. If we stop offering the service altogether, we will give you at least 30 days' notice to export your data, and send you your records on request for the rest of their 8 years.
Our software
We own the software, design and brand. You may use the service while your account is open, but you do not get ownership of it.
Disclaimers
Apart from the promises made in these terms, the service is provided as it is. We do not guarantee that it will be free of errors or suit every business.
Limit of liability
As far as the law allows, we are not liable for indirect losses such as lost profit, lost business or penalties arising from invoices you issued. Our total liability for any claim is limited to the fees you paid us in the 3 months before the claim arose. Nothing in these terms limits liability that the law does not allow to be limited.
Indemnity
If someone brings a claim against us because of the data you entered, the invoices you issued, or your breach of these terms, you will cover our reasonable costs of dealing with it.
Changes to these terms
When these terms change, we update the date at the top of the page. If a change materially affects you, we will email account holders at least 30 days before it takes effect. If you keep using the service after that date, you accept the change.
Governing law
These terms are governed by the laws of India. Any dispute is heard by the courts at Siliguri, West Bengal.
